Scope of Purchased Educational Service

1. Your one-time purchase grants you a personal, non-transferable license to access the Gestalt Trading Bootcamp digital educational service ("Service"). This Service consists of: (a) structured learning resources delivered through a digital platform ; (b) digital learning aids, tools, and templates ("Learning Resources") curated to support the learning experience; (c) access to our digital community platform ("Group Access"); and (d) any future updates made available as part of the Service. Future updates refer to improvements or additions to existing materials. We are not obligated to provide new standalone products or services beyond the originally offered content. All components are delivered digitally through electronic means outside the United States. Access is provided for the operational lifetime of the Service, defined as the period during which the Service is actively maintained and offered by Gestalt Labs LLC, subject to these Terms. Access continues unless and until the Service is discontinued or retired, at which point we may, but are not obligated to, provide prior notice. This does not imply a guaranteed minimum duration, and we reserve the right to retire the Service at our discretion.
2. Your access to and use of the Service and learning resources are strictly subject to the following conditions. You are expressly prohibited from:
   • Reselling, renting, leasing, distributing, or otherwise sharing your access credentials or the learning resources with any third party.
   • Transferring your access rights to the Service or Group Access to another individual or entity.
   • Representing the learning resources as your own creation, claiming authorship, or removing any proprietary notices.
   • Using the Service or learning resources for any commercial purpose other than your own personal educational development, or for any unauthorized use not expressly permitted by these Terms.
   • Attempting to download, scrape, copy, modify, reverse-engineer, or create derivative works from components of the Service or learning resources.
3. All learning resources, the structure and presentation of the Service, and all associated intellectual property rights are owned by Gestalt Labs LLC and are protected by copyright, trademark, and other applicable laws. Unauthorized use, reproduction, or distribution constitutes a breach of these Terms and may result in immediate termination of your access without refund and potential legal action.

Educational Purposes Only

1. All components of the Service and learning resources provided are for educational and informational purposes only. They are not intended to be, and should not be construed as, financial advice, investment advice, trading recommendations, or any other form of professional guidance.
2. You acknowledge that any decisions or actions you take based on information obtained through the Service or learning resources are your sole responsibility, and we are not liable for any outcomes resulting from such decisions or actions.
3. Gestalt Labs LLC provides structured learning resources and information curation as a service, we do not provide financial advice, investment recommendations, or brokerage services. The Service is designed to educate users about market dynamics and analysis techniques.

Privacy Policy

1. We do not sell, rent, or share any personally identifiable user data with third parties.
2. Payments are securely processed through third-party providers such as Whop(Stripe) and NOWPayments. We do not store any payment credentials on our servers.
3. Emails for purchase confirmation, invoices, and delivery of access credentials or learning resources are managed by Resend and Stripe, and are not stored on our primary servers.
4. We use services like Cloudflare and Vercel, which prioritize privacy and do not typically require cookies or invasive tracking mechanisms. They are used primarily to filter malicious traffic and monitor server health for service delivery. We also use analytics tools such as Meta Pixel and TikTok Pixel to improve the Service and measure ad performance. These tools may collect data such as IP address, browser type, and activity on the site. Use of these tools is subject to the respective platforms privacy policies. We do not receive personally identifiable information from these platforms.

Cookie Policy

1. We do not use cookies to collect or sell personal data, and we do not share identifiable user information with third parties.
2. We use essential cookies required for the secure and functional operation of our website. These include cookies managed by our hosting and CDN providers (Cloudflare and Vercel).
3. We also use marketing and analytics technologies such as Meta Pixel and TikTok Pixel to track ad performance and user behavior. These tools may use cookies or similar identifiers to collect data like IP address, browser type, or on-site activity. This tracking is subject to the respective platform’s privacy policies.
4. You can manage your cookie preferences through your browser settings or opt out of personalized ads.

Termination of Access

We reserve the right to terminate or suspend your access to the Service, learning resources, and Group Access at any time, for any reason, including but not limited to a breach of these Terms, without prior notice or liability. This decision is at our sole discretion, and you agree that you are not entitled to any refund or compensation in the event of such revocation.

Payment and Refund Policy

1. All purchases for access to the Service are final. Due to the immediate access granted to the digital service components and learning resources upon purchase, we do not offer refunds, returns, or exchanges under any circumstances.
2. Please ensure you carefully review the description of the Service and learning resources on our website before completing your purchase. By completing the purchase, you acknowledge and agree to this no-refund policy.

Disclaimer of Warranties

1. The Service and all associated learning resources are provided strictly on an "as is" and "as available" basis without any warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, or non-infringement.
2. We do not warrant that the Service or learning resources will meet your specific requirements or expectations, that access will be uninterrupted or error-free, that defects will be corrected, or that the information provided will be complete, accurate, or reliable.

Limitation of Liability

1. To the maximum extent permitted by applicable law, Gestalt Labs LLC, its owner(s), affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service or learning resources; (ii) any conduct or content of any third party on the Service (including Group Access); (iii) any content obtained from the Service or learning resources; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
2. In no event shall the aggregate liability of Gestalt Labs LLC for all claims relating to the Service exceed the total amount you paid to us for access to the Service.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in Wyoming, USA, and you consent to the personal jurisdiction of such courts.

Amendments

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect, though notice is not guaranteed. What constitutes a material change will be determined at our sole discretion. Changes will be effective immediately upon posting the revised Terms on this page. Your continued access or use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.

Service Delivery and Tax Treatment

1. Gestalt Labs LLC is a U.S.-registered entity that delivers digital educational services exclusively through online platforms, with all business operations conducted from outside the United States.
2. The Service includes structured learning resources, community access, and supplementary digital tools. It is provided solely for personal educational use and does not involve any transfer, assignment, or license of intellectual property rights.
3. All payments for the Service are processed by Whop.com, acting as the Merchant of Record. A one-time payment of $119 USD grants the user perpetual access to the digital content and future updates, subject to the Terms.
4. The Service is not provided through a U.S. office, fixed base, or dependent agent, and Gestalt Labs LLC has no U.S.-based employees or place of business. Accordingly, income from the Service is not effectively connected with a U.S. trade or business (“ETBUS”) and is not considered U.S.-source income under applicable tax law.
5. This Service does not generate U.S.-source royalty income and is not subject to withholding under Internal Revenue Code Sections 1441–1443. Gestalt Labs LLC will provide a valid IRS Form W-8BEN to the Merchant of Record as required.
